Arizona Law and Statutes on Dog Bites

Arizona has several statutes on books which clearly define the liability for a dog bite such as ARS 11-1025 which specifies the liability for dog bites, and ARS 11-1027 which governs damages from a dog bite if deliberate provocation was the main reason for the dog bite.

Liability of the Owner

As per Arizona Law, the owner can be held liable for dog bite irrespective of the negligence of the owner or his knowledge of the incident. Arizona is known to have quite strict dog bite laws. If the owner is not present and a caregiver is responsible for the dog, then the caregiver and owner may be jointly held liable.

An owner of the dog is almost always liable for a dog bite in Arizona, and he or she can escape the liability only in few cases. The owner would not be liable if the victim provoked the dog into biting him through his actions or any other action which may be considered as a provocation for a dog by a reasonable person.

The owner is also off the hook for damages if he can prove that the victim entered the property unlawfully or was trespassing or if he avoided clear warning signs about the presence of a vicious dog.
 
Statute of Limitations

Arizona has a statute of limitations of 1 year from the day of the dog bite incident for filing a claim. Although, a victim can also file a claim under the common law negligence in which case the statute of limitations is 2 years.
